We grant you a limited, non-exclusive, non-transferable license to access and view the Site for personal or internal business evaluation purposes. This license does not permit you to download (other than page caching), modify, or use any portion of the Site content for commercial purposes without our prior written consent.
Information submitted through our wholesale inquiry form is used solely for the purpose of evaluating potential business partnerships. Submission of an inquiry does not create a binding obligation on either party.
Any wholesale or distribution partnership with AirPop is subject to a separate written agreement. These Terms do not constitute an offer to sell products or establish a business relationship. Specific terms including pricing, minimum order quantities, payment terms, delivery schedules, and return policies will be outlined in individual partnership agreements.
We make reasonable efforts to ensure that product descriptions, specifications, certifications, and pricing information on the Site are accurate. However, we do not warrant that all information is complete, current, or error-free. Product specifications and availability are subject to change without notice.
AirPop products include respiratory protection devices and breathing wellness accessories. They are not medical devices and are not intended to diagnose, treat, cure, or prevent any disease. While our respiratory protection products meet or exceed applicable certification standards (ASTM F3502-21, NIOSH benchmarks), no respiratory protection device can eliminate all risk of exposure. Sleep breathing and airflow wellness products are accessories intended to support comfort and habit formation, not medical treatments.
Users should follow all applicable guidelines and instructions for proper use, care, and replacement of AirPop products.
Direct sales of AirPop Sleep products (including AirPop Restore, AirPop Flow, and the AirPop Sleep System) made through this Site are fulfilled by our authorized affiliate, which acts as the seller of record. Order confirmation, payment authorization, shipping notifications, and refund processing for direct-to-consumer purchases are governed by this section.
All direct-to-consumer prices are listed and charged in U.S. Dollars (USD). Applicable taxes, duties, and shipping charges are calculated at checkout based on the destination address. Subscription pricing and promotional discounts (including waitlist discounts and early-access offers) are subject to the terms stated at the time of order.
We currently ship to addresses in the United States and Canada. Standard shipping is free on orders of $19.99 USD or more (calculated before tax). A flat-rate shipping fee of $4.99 USD is applied to orders under $19.99 USD. Most U.S. orders ship within two business days of order confirmation and arrive within three to seven business days via USPS or comparable carriers. Delivery times to Canada and remote U.S. destinations may be longer. AirPop is not responsible for carrier delays.
We stand behind the AirPop Sleep system. If, within thirty (30) nights of delivery, you do not feel that AirPop Restore or AirPop Flow has improved your sleep, you may request a full refund of the purchase price.
How to request a refund. Email support@getairpop.com with your order number and a brief note. We will issue a full refund to the original payment method within seven (7) business days of confirming your eligibility.
What we cover. The refund applies to the product purchase price only. Shipping fees previously paid by the customer (orders under the free-shipping threshold) are non-refundable. International duties, customs fees, and taxes assessed by carriers or governments are also non-refundable.
No return shipping required. For hygiene reasons, used or partially used product does not need to be returned. We ask that you discard unused product responsibly. We reserve the right to require return of unopened product or to limit the guarantee to one (1) refund per household when fraud or abuse is suspected.
Eligibility.The trial covers direct purchases made through getairpop.com or sleep.getairpop.com only. Products purchased through retail partners (including but not limited to Target, Amazon, or other third-party retailers) are subject to those retailers' own return policies. Subscription orders are eligible on the first delivery only; subsequent shipments may be cancelled at any time through your account but are not subject to the 30-night guarantee.
Subscription orders renew automatically at the cadence selected at checkout (every 30, 45, or 60 days) and at the subscription price displayed at the time of order. You may pause, skip, or cancel your subscription at any time through your account portal or by emailing support@getairpop.com. Cancellation must be received at least three (3) business days before the next scheduled renewal date to avoid that renewal shipment.
If your order arrives damaged in transit or contains an incorrect item, please email support@getairpop.com within seven (7) days of delivery with photos of the issue. We will arrange a replacement or refund at no additional cost.
The Site contains links to third-party websites, including authorized retail partners (e.g., Target.com, Amazon.com) and social media platforms. These links are provided for convenience only. AirPop does not control, endorse, or assume responsibility for the content, privacy policies, or practices of any third-party sites. Purchases made through retail partner websites are subject to those retailers' own terms and return policies.
THE SITE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. AIRPOP DOES NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL AIRPOP, ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:
You agree to defend, indemnify, and hold harmless AirPop and its licensors, employees, contractors, agents, officers, and directors from and against any claims, damages, obligations, losses, liabilities, costs, or debt arising from your use of or access to the Site, or your violation of these Terms.
These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions. Any disputes arising under these Terms shall first be attempted to be resolved through good-faith negotiation. If negotiation fails, disputes shall be resolved through binding arbitration in San Francisco, California, in accordance with the rules of the American Arbitration Association.
We reserve the right to modify these Terms at any time. Changes will be effective upon posting to the Site with an updated "Last Updated" date. Your continued use of the Site after changes are posted constitutes acceptance of the revised Terms. We encourage you to review these Terms periodically.
If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions shall continue in full force and effect.
